Franklin County Clerk of Court
The Franklin County clerk structure is unified for local court filing records, but the same courthouse setting also includes the elected county Clerk/Auditor/Recorder duties. The Franklin County Clerk page identifies Camille Larsen as county clerk and lists the clerk office at 39 W Oneida St. in Preston. The District and Magistrate Court page separately identifies court clerk staff who handle district civil, district criminal, magistrate criminal, juvenile, magistrate civil, record requests, and jury work.
This distinction matters for Franklin County Clerk of Court records. A civil or criminal case copy goes through the court clerk and the court records request process. A recorded land document or marriage-license copy may route through the county Clerk/Auditor/Recorder. Marriage-license processing is also a clerk office service, with a county rule to arrive before 4:00 p.m. for processing.

The Franklin County Clerk office page is the source for the local clerk contact and fee notes used here.
The clerk office page is useful for recorded-document copies, marriage-license copy questions, and clerk staff duties, while case copies use the court records request channel.

- Use iCourt and the courthouse public kiosk for public case research before ordering copies.
- Use the county clerk for recorded document copies, marriage-license services, and county administrative records.
- Use the Court Assistance Office for self-help forms and local form guidance during its posted service hours.
Note: The clerk page says staff may be unable to assist with some document searches at certain times, especially during election season.
Request Franklin County Certified Copies
Certified copies are court or clerk copies with an official certification that the copy matches the filed record. They are often needed for legal filings, agency proof, appeals, banking, land-record follow-up, name changes, and other formal uses. In Franklin County, certified court documents are requested through the local court records request form when the case document is public and can be released.
- Search the case in Idaho iCourt or at the courthouse public kiosk to confirm the case number and document title.
- Complete the Franklin County court records request form with party names, case number, and the specific document requested.
- Check the certified-documents option and choose delivery by printed copy, fax, email, or mail if available for the record.
- Pay the copy charge and the $2.00 certification fee per document. Older files may require the extra research fee listed on the form.
- Wait for processing. The form says requested information may take up to three business days, with written notice if more time is needed.
The request form also allows hearing audio requests for a specific hearing date. Audio is listed at $12.00 on flash drive, and the requester must identify the hearing clearly enough for staff to locate it.
Franklin County Request Form Fields
The Franklin County court records request form is more detailed than a generic copy note. It tells users to make requests in writing, warns that public information cannot be used for mailing or telephone lists under Idaho Code 9-348, and separates public inspection from copies, certification, and audio.
| Field | Required | Notes |
|---|---|---|
| Date | Practical yes | Request date appears at the top of the form. |
| Party names | Recommended | Needed to identify the right case when case number is unknown. |
| Case number | Recommended | The form says cases can be researched at the public kiosk or iCourt. |
| Specific document title | Yes for copies | Use exact document names when possible. |
| Records pertain to requester | Conditional | ID may be required if the records specifically pertain to the requester. |
| Delivery format | Optional | Printed, faxed, emailed, or mailed choices are listed. |
| Signature | Yes | Includes the list-use restriction statement. |
Idaho Code 74-102 supports the public right to inspect and copy public records unless another law restricts the record.
That open-records presumption works with Idaho court rules and confidentiality laws, so sealed or restricted court records may still be withheld from public release.
Franklin County Clerk Fees
Franklin County publishes both court-copy fees on the court records request form and recorded-document fees on the county clerk page. Do not mix them. A certified court document fee is not the same as a recorded deed fee, and a marriage-license copy is handled by calling the clerk office.
| Item | Amount or instruction |
|---|---|
| Court copy | $1.00 per page |
| Certified court document | $2.00 per document, plus copy charges |
| Hearing audio | $12.00 on flash drive |
| Pre-October 1, 2018 case research | $20.00 nonrefundable research fee upon request |
| Recorded document copy | $1.00 per page |
| Marriage license copy | Call 208-852-1092 |
Recorded-document fees are separate. The clerk page lists deeds, grants, and conveyance documents up to 30 pages at $15.00, with $3.00 for each additional page. Trust deeds, mortgages, fixture filings, security agreements, and assignments in the same instrument are listed at $45.00. Reconveyances and mortgage releases are listed at $15.00, and power of attorney recordings are listed at $25.00.
Common Franklin County Clerk Forms
The most important court-record form is the Franklin County public records request form for case copies, certified documents, audio, and older-file research. The court page also links Idaho Court Assistance resources for self-represented people, including forms for divorce, custody, child support, small claims, guardianship, conservatorship, protection orders, and other case types.
- Franklin County District and Magistrate Court links local court records, jury, payment, and hearing resources.
- Franklin County Court Assistance Office lists Kaybree Ozburn, local contact information, and service hours.
- Idaho Court Assistance forms provide statewide self-help form categories.
- Franklin County marriage licenses gives local marriage-license requirements and fee information.
Online, Kiosk, and Mail Access
Franklin County Clerk of Court records access uses a practical chain. Start online with iCourt for public case status, hearing calendars, and payment searches. Use the courthouse public kiosk when the public portal is not enough. Use the written records request form for copies, certified documents, specific hearing audio, and older files. The form supports printed, faxed, emailed, and mailed delivery options.
Public users do not need to register for basic iCourt public access. Extended access is different. Idaho's extended-access process is for approved officials or agents with a qualifying role under court rules, and it does not let ordinary public users bypass sealed, confidential, or exempt records.
The U.S. Attorney District of Idaho contact page is federal context only and should not be used for ordinary Franklin County clerk copy requests.
State court records, county recorded documents, and federal prosecution records are different systems, so matching the request to the right office saves time.
